Isn't it usually that you have to call them something else, but keep the same personalities? You know, it's the names that are copyrighted, not character behaviour.

Actually, if they could use any of the uniforms of any Trek up to and including Enterprise, they totally would because of merchandise sales.
As it stands, they don't have the rights to actual Trek and as such whatever they make isn't actual Trek and has to be noticeably different. Even the characters, their backstories and so on. They are not legally allowed to write the characters like they originally are. That's why Spock is emotional in JJ Trek and why Kirk is a total faggot.
I still blame that faggot Alex Kurtzman for a lot of that.They could have just given Spock more alien mumbo jumbo instead of reversing his most defining character trait. The rest of it is shit too. As for Kirk, he basically made him the meme version of Kirk but without any of the charm.
It's not just the licensing issues. Yeah, they have to make it 25% different, whatever the hell that means, but they've also kept a shitty writer at the helm.

Something that not even the TOS movies ever really got right was that Kirk was actually a pretty competent captain in the 60s show. The whole concept of him being this Peter Pan figure who got everything done by cheating is a myth.

Dude outsmarted crazy killer AIs and went all MacGyver ond lizard dudes. Should've called his ship the Chadprise.
JJ Trek was especially bad with Kirk's portrayal. His daddy's BFF was an admiral who was convinced he's special or something, and him cheating during the Kobayashi Maru felt more like Jar-Jar trying to rip off Galaxy Quest or something.
Autism attracts more autism. Sooner or later, an internet nobody will attract the exact kind of fans - and detractors - he deserves.

For once Rushy is dead right. Original series Kirk wasn't chasing sexy alien tail and challenging ugly aliens to wrestling matches. Green skinned space babes threw themselves at him and muscular lizard men threw themselves at him in a different way because his sheer testosterone drew that kind of attention. Most of the time he was a level headed captain who made the smartest choice he could with the info he had.
At least with the TOS movies you can write it off as Kirk having issues with getting old. Too much of the other bullshit that comes out is fanfic tier.

And what's more, his crew actually felt like a legitimate, living crew in the old episodes - something that *no* Trek series was able to replicate. Kirk being the captain made him not just a figure of authority, but an *intimidating* figure of authority, to the point where, in the famous episode where he gets split into good and evil halves, Spock demands that he not inform the crew in order to make sure nobody thought the Captain was compromised. His position mattered that much.
Everyone else also come across extremely professional - there's some minor banter as there would be, but you get the sense that these people aren't really friends so much as colleagues who trust each other because of their shared experiences.
It's impossible to accept that Discovery and TOS take place in the same time frame, because the Discovery characters' 2010s behaviour just wouldn't be tolerated in Kirk's era.

I really liked that episode, especially the concept of how Good Kirk was weak and unfit to command the ship. He needed his Evil half to be Captain and to lead. I didn't understand that as a kid, but I totally do now.
The selfish desire for power that you see in our modern day politicians and such would be the same sort of ambition for someone like James T. Kirk to be able to become the youngest Captain in Starfleet. And the toughness to make decisions that could send men (and women) to their death if necessary. All this would come from his Evil side I think.
