I'm no lawyer but Texas's murder law does include "intends to cause serious bodily injury and commits an act clearly dangerous to human life that causes the death of an individual" as an option. So I'd think they could get him for murder depending on the circumstances (like he stabbed him in the chest or neck with a decent sized knife versus hit an important artery on limb slashing a pocket knife).
But, I don't think the state will go there if the victim's family isn't pushing for maximum charges because manslaughter does seem like a slam dunk.
"Murder" in Texas will get you about 3x the sentence of manslaughter. To get the death penalty you need to be convicted of "capital murder" which requires premeditation.
I suppose there is the argument that Anthony's family is going to try and drag it out to find outright exoneration, you'd need someone Johnny Cochran levels of good to pull that shit off with all the eyewitnesses.
I suppose we'll figure out soon when they announce where the victims family reveals where they're going with charges, there's mutual interest in compromising on manslaughter. Less time for the nog and the victims family doesn't have to drag this out.
