They didn't even include Scarecrow because TAS already had all the Scarecrow designs you could possibly ask for.

They didn't include the Scarecrow because Nolan had already used him and the Bat Embargo prevented them from also using him.
Timm also wanted to use the Scarecrow for JLU because he was part of the Legion of Doom, but Warners said no

Of course the rules governing the Bat-Embargo were pretty fucking stupid and arbitrary and part of the reason why a lot of people ended up hating The Batman. Because of that show, DCAU Joker and other big name Batman villains couldn't appear on JLU. Timm and Co even had to fight a bit to let them use Batman, can you imagine?

How about you create new characters and new villains so you won't need to keep an autistic schedule of who can use what when and where? Oh yeah, that's the Western comics industry, where zero effort is put on anything and rehashing the same 80 years old property is seen as natural.

Warners don't care about Superman. Just look at the quality of Returns or the general state of the character in more recent years. It's also easier to make Batman live-action movies. Superman's power level is so high that he basically requires stupid DBZ battles, which wasn't technically feasible for the longest time.
And while Batman's core rogues' gallery is well-known, Superman adaptations have a tendency of just giving him Lex Luthor or some other evil businessman/scientist.

Their problem is they don't know what to do with him. They don't know how to write the character. They've also got Siegel's estate on their ass constantly with legal battles over ownership of the character, which they don't have with Batman because Bob Kane took all the credit and then signed over all the rights in exchange for a reasonable financial settlement. Which is ironic, actually, because the reason Superman was the first DC character to be merchandised and the reason Superman got the Fleischer cartoons and his own radio show and all that, and Batman didn't, was that DC pretty much swindled the rights to Superman from Siegel and Schuster and gave them nothing in return, whereas Bob Kane was too smart for his own good and asked for a big cut of anything they made featuring Batman. It's only in the 60s when they renegotiated his contract that stuff like the Adam West series could be made.
