My understanding on how retarded the FTC was here is in their arguments. They were parroting Sony talking points the whole time and not why it may be bad for the consumer. That's why the judge thought they were retarded with her pointing out Nintendo exists and Microsoft made a deal with Nintendo to bring Call of Duty to their systems for the next 10 years so there wasn't true exclusivity to Microsoft products
