The EU is basically complaining that the current Belgium restrictions, some of the most strict in Europe, aren't law and used an NGO (name one in Europe that hasn't been busy destroying Europe in the last twenty years) to kick of the process to ratify this shit into law.
It's a very, very small step from Belgian law to EU law.

Now why would they do that? Could it be because there are nations, like Germany, where curfews, outside of martial law, are unconstitutional?

Sure, an override of EU law over the constitution would eventually get overruled in our constitutional court but that would take months and until then they can just enact a curfew in all of EU Europe until the local constitutional courts have decided it to be illegal.
Months in which they will just arrest you and not even owe you compensation after it because it's the state so fuck you.

If this was an honest, respectable pandemic like the Spanish Flu, these would be great news for you, because the third wave was the last one and it was much weaker than the second wave. You could be looking into this stupidity to be over in six months or so, like the Spanish Flu was over in 18 months in some places - without vaccines and with a world ravaged by war.
