It's some ill-defined shit. It's a banned symbol but may be used for art or educational reasons. That's pretty much the entire phrasing of the law and because of that it's never quite clear to anybody where and when you are allowed to use it and when not.
In the newest Wolfenstein they are allowed, in all previous vidya they had to be removed. For movies you may generally use them but then sometimes not for no good reason and so on. It's silly. It's very much like "fair use" laws where nobody is ever quite sure what is and isn't fair use.
