The excuse they give is that heterosexuals already are judged with this discretion and instead of closing the loophole like a normal person would have done they expanded it.

But what they didn't tell people was why the discretion for heterosexuals is the requirements for it to work. First, it was only allowed with vaginal penetration with the reasoning that if the minor being a girl got pregnant that the father would be able to support the child. So child support in the sense. Of course butt fucking has zero to do with making children and the figs are avoiding bringing that up.

Another thing is that while the minor can't be younger than 14, the 10 year gap is way too much obviously. Most people would take a 5 year gap since it would make sense from a logical point. We already know that 2 teens can be dating and the girl's parents don't like the boyfriend so the second he turns 18 and she is still underage they file a complaint of him fucking a minor. This is what the discretion that people will accept. That's why there are Romeo and Juliet laws in a bunch of states.

By having the 10 year gap, you have 24 year olds fucking 14 year olds and no normal person will accept that since it's a full grown adult screwing a underage teen.
