That burden is relatively low, actually. Beating the shit out of him? Fine. Stabbing him in a struggle, might be fine with a good lawyer. He had a log, not a club or something he could reasonably fight you with.
Getting your gun from the safe to confront him? Guaranteed at least manslaughter.

If you live a sanctuary shitty like me, it's almost as bad as Europe. If you shot this troglodyte in my town, there'd be a "Justice for J'Shawn" rally the next day demanding you be prosecuted.
